   This has been  along time coming. We have prevailed with the 70/30 Grievance and here is the award ( See Below ) .Thank all of you for your support during this challenging time .The UAW will always stand up to right  a wrong. Thank God for smiling on the Mt Holly Freightliner family

Award

       The company violated the LOU contained in the CBA when it laid off substantial numbers of employees in late 2008 and 2009, but did not subsequently produce 70% of M2 's sold in the US and Canada at it's Mt Holly plant, as required by the contract. Such conduct made the Mt Holly workforce , in the language of the LOU, " disproportionately disadvantaged," and entitled to a remedy for the contract violation.

       As a remedy for the above violation, the company shall increase production with bargaining  unit employees  at Mt Holly to 70% of the M2's sold in the US and Canada, calculated on a monthly basis . The Company also shall make whole any bargaining unit employee  who has been adversely affected by it's contract violations, including layoffs  beginning near the end of October and early November 2008, and continuing thereafter. The arbitrator refers the question of employee losses back to the parties for further consideration  and determination, but shall retain jurisdiction to determine any disputes over the interpretation or application of this award, including the extent of employee losses .

Brothers and Sisters,

We are assisting UAW Heavy Tuck Department with data for the settlement on the arbitration decision. This will be no overnight task but UAW Heavy Truck Department has assured me they are doing every thing possible to get a fair and equable settlement.

I want the membership to understand the process. When a grievance reaches the level of arbitration, the UAW Heavy Truck Department of the International Union will handle all the details of the settlement, with our local union support. The International is compiling data for who, what, when and why. They have the resources on staff to handle a settlement of this magnitude.

Once again, I would like to thank all of you for your support and encouraging words. We have been overwhelmed by the show of support we have received. Your leadership has brought us this far, we will finish the job that we started for this membership.

The food bank is still going great. We have now assisted over sixty-five (65) families who are currently on lay off. I will continue my effort to go to the local store and ask them for donations, so we can continue to  provide assistance . Members in the plant are doing their part by continuing to bring items for the food bank.

Make no mistake about it; we will continue our Buy American Campaign. We are still seeking volunteers for next up coming event.
